Obama accused of disrespecting court, state, Americans

(WND) - One of the attorneys who fought a court case over Barack Obama’s eligibility to be president all the way to the U.S. Supreme Court says he fears that even if the U.S. Supreme Court declared Obama unqualified, he’d simply ignore the ruling and continue issuing orders.

But those who observed a court hearing today in Atlanta say it could be the beginning of the end for the Obama campaign, because of the doubt that could surge like a tidal wave across the nation.

The comments came today from Leo Donofrio, who led the pack in filing lawsuits over Obama’s 2008 election and his subsequent occupancy of the White House.

He was commenting on today’s hearing before a Georgia administrative law judge on complaints raised by several state residents that Obama is not eligible to run for the office in 2012. That hearing went on after Obama and his lawyer decided to snub the court system and refuse to participate.

A decision from the judge, Michael Malihi, is expected soon.

The Georgia residents delivered sworn testimony to a court that, among other things, Obama is forever disqualified from having his name on the 2012 presidential ballot in the state because his father never was a U.S. citizen. Because the Constitution’s requirement presidents be a “natural born citizen,” which is the offspring of two citizen parents, he is prevented from qualifying, they say.

The historic hearing was the first time that a court has accepted arguments on the merits of the controversy over Obama’s status. His critics say he never met the constitutional requirements to occupy the Oval Office, and the states and Congress failed in their obligations to make sure only a qualified president is inaugurated, while his supporters say he won the 2008 election and therefore was “vetted” by America.

In Georgia, the law requires “every candidate for federal” office who is certified by the state executive committees of a political party or who files a notice of candidacy “shall meet the constitutional and statutory qualifications for holding the office being sought.”

State law also grants the secretary of state and any “elector who is eligible to vote for a candidate” in the state the authority to raise a challenge to a candidate’s qualifications, the judge determined.

Citizens bringing the complaints include David Farrar, Leah Lax, Thomas Malaren and Laurie Roth, represented by Taitz; David Weldon represented by attorney Van R. Irion of Liberty Legal Foundation; and Carl Swensson and Kevin Richard Powell, represented by J. Mark Hatfield. Cody Judy is raising a challenge because he also wants to be on the ballot.

Donofrio’s case – like all the others that have reached the Supreme Court – simply was refused recognition.

“That President Obama’s attorneys didn’t show respect for the court, the citizens, the secretary of state, and the statutes of Georgia reveals the true character of the administration as being completely and utterly against state’s rights,” Donofrio said. “The federal government is growing out of control with every administration and this action today is a loud announcement that this administration is going to do what it likes, and you can imagine that their response to this judiciary would be exactly the same if this had been the U.S. Supreme Court.”

He said if Georgia does decide to keep Obama off its state election ballots, he won’t appeal to the U.S. Supreme Court, “because if he were to lose there, his entire administration would be void, including his appointments to the Supreme Court.”

“If Obama were to appeal in Georgia, only this election is in play, and only as to Georgia’s ballots, but if he loses in Georgia, appealing to the SCOTUS brings in his entire eligibility, and the legitimacy of his current administration,” Donofrio warned.

“My personal belief is that if the U.S. Supreme Court held that he was ineligible, he might simply ignore the ruling, and test the will of the nation, just as he is testing the will of the state of Georgia,” he said.

The White House today was absolutely silent about the issue. The Georgia case is far different from the lawsuits over the 2008 election, in which judges virtually unanimously ruled that they could not make a decision that would remove a sitting president, no matter the circumstances.

This hearing was about concerns being raised, as allowed by Georgia state law, that Obama is not eligible for the office of president and therefore should not be allowed on the 2012 election ballot.

“If the judge’s recommendation – and I’ve been told that it’s going to be to disqualify Mr. Obama as a candidate – is followed by the secretary of state, Mr. Obama has got a real problem,” said Gary Kreep, of the United States Justice Foundation.

His organization pursued several of the lawsuits over Obama’s occupancy of the Oval Office to the U.S. Supreme Court, where the justices simply decided they wouldn’t be bothered with such issues as the constitutional eligibility of a president.

“He’s thumbed his nose at the court. He’s thumbed his nose at the secretary of state in Georgia. He’s thumbed his nose at the people and said, ‘I’m above it all. I’m above the law,’” Kreep said.

Kreep’s cases have outlined out there is precedent in the U.S. for the removal of a sitting chief executive because of an issue over ineligibility.

Obama’s attorney, Michael Jablonski, had warned Secretary of State Brian Kemp yesterday that he needed to simply call off the hearing, and he and Obama would not participate.

Not only did Obama not participate, there also was no comment.

On a day when Obama was campaigning in Arizona and Colorado, he released formal statements about the retirement of Congressman Brad Miller, and the retirement of Gov. Bev Perdue.

But WND calls to the White House brought only the instructions to e-mail a question to the media affairs department. WND did but got no response. WND also contacted Obama’s campaign headquarters, to receive instructions to email a question. WND did again, but again got no response.

Jablonski, the Atlanta attorney representing Obama, also declined to return WND messages left at his office today.

Mario Apuzzo, who also shepherded a case to the Supremes, said Obama, by not showing, “actually failed to meet his burden of proof, to show that he is eligible and should be placed on the ballot.”

“For him to just ignore due process here is really telling a lot,” he said, noting, “This decision will have a ripple effect.”

“He’s not above the law. That’s a very important thing here. He’s a private person running for office, so he had no business not showing up. So the court can enter the judgment, and then the secretary of state does what he wants with it. And this will have a ripple effect for other secretaries of state, for other states, for the public. Also for any case that could be pending in the Supreme Court, where the issue of Mr. Obama’s eligibility is implicated,” he said.

“It’s a really important milestone that has been reached.”

Apuzzo warned that an administrative law judge certainly wields authority in such cases.

“We had a legitimate hearing in a legitimate court where this private person, Barack Obama, was asked to come there and satisfy the basic Georgia election law ballot procedure, and he doesn’t show up. Nor does he send an attorney. We don’t see this on television yet, but I can’t imagine this not being major news. It boggles the mind that a sitting president who is running for re-election doesn’t show up at a state’s legitimately constituted proceeding to make sure that he is indeed eligible to be on the ballot,” he said.

Charles Kerchner, on whose behalf one of those cases went to the Supremes, said, “Obama thinks he is a king and thus not subject to the election laws of Georgia and the United States Constitution. He will soon learn otherwise.”

He continued, “As the Georgia secretary of state said in warning Obama and his attorney if they did not show.up for the court hearing today … if they do that, they will do so at their own peril.”

Kreep, who has fought battles in both state and federal courts over the issue, said a ruling that would remove Obama’s name from the Georgia ballot would be a “tremendous victory for … America.”

“If the judge issues a default and rules that Barack Obama will not be on the Georgia ballot, and if the secretary of state upholds that, then Mr. Obama, having told the court to essentially stick it in their ear, he wasn’t going to participate, wasn’t going to recognize their power – he’s going to have a tough time convincing some other court to overturn the ruling, because he waived his right to object to it by not appearing,” he explained.

“That’s a big deal to judges. A judge may or may not agree with another judge’s ruling, but when one party waives their ability to object, judges are very reluctant to get involved, because the party has basically said, ‘We don’t care what you do, we’re not going to abide by it.’ Judges don’t like that. They don’t like to be blown off,” he said.

He said the election outcome also could be decided because of not being on a ballot in even one state. And he said there’s more to come.

“I can tell you from my own personal knowledge that there are challenges going on in other states. Van Irion has one in Arizona and one in Tennessee. We have one in Illinois that is has gone under the radar. We’re going to be filing similar challenges around the country. We’ll be filing one within a week and another right around the end of the month,” he said.

Following claims made by US Navy SEAL Chris Kyle that he punched Jesse Ventura for badmouthing US troops during a wake for a slain soldier in Coronado, California, Ventura has denounced the story as an outrageous lie, asserting that the event never happened.

Kyle, who has been the subject of numerous television interviews over the past few days while he promotes his new book, is a sniper marksmen who has been made into somewhat of a poster child for US military involvement in the Middle East following his tales of killing hundreds of Iraqi insurgents.

Kyle claims that he met Ventura in a bar in Coronado in 2006 while Ventura was in town to speak to a new class of SEAL graduates at nearby Naval Amphibious Base Coronado. Also present were family members holding a wake for Michael Mansoor, one of the first SEALs killed in Iraq. Kyle claims Ventura began loudly objecting to the war in Iraq before calling the troops "murderers" and saying "we deserved to lose a few guys".

Kyle then claims he punched Ventura, knocked him to the floor, and quickly ran away.

Infowars today spoke with Tyrel Ventura, Jesse Ventura's son, who related to us how Ventura is shocked, heartbroken and saddened about how a fellow Navy SEAL could invent such a hurtful and abhorrent lie.

The event never happened, Ventura has never met Kyle, and the whole story is a transparent hoax seemingly designed as an attempt at character assassination given Ventura's very public recent battles with the federal government, in particular his fight with the TSA, and his vehement anti-war stance, Tyrel told us after talking with his father.

Ventura explained that he has only ever visited the bar in question with groups of friends, and the notion that the story if true would not have already become public in the space of over five years is plainly ludicrous.

Ventura labels the story a total fabrication and is beyond heartbroken that a fellow service member and Navy SEAL would invent such outrageous lies designed to defame him and help sell a book. He adds that it is incredibly vicious to claim at a wake he would insult the family members of a slain soldier, which is one of the worst slurs that could be made against anybody, not to mention a former Navy SEAL like Ventura.

In his Facebook response, Ventura makes reference to another false claim that had to be retracted about him supposedly tail gating in California last week, suggesting that there is an organized effort to "destroy my credibility".

Such actions may be an effort to pre-empt the possibility that Ventura could enter the presidential picture as a candidate for the Libertarian Party. Tyrel Ventura told us that Jesse is completely blown away that the establishment is now coming after him by way of manufactured hoaxes and cynical acts of character assassination in a bid to politically discredit him.

But you can't legalize tyranny. One of the nation's most well known legal precedents, Marbury vs. Madison, set in 1803, makes clear that any "law" that is "repugnant to the Constitution is null and void."

The blatant unconstitutional powers enacted in the legislature and executive branch is backfiring, however. This crowning act of tyranny is awakening people to the true intentions of Big Government in its takeover. The NDAA is so openly in violation of the American way, that Obama had to play lip-service to it in his signing statement language, even as he gave it the power of law.

Critics in the ACLU and Human Rights centers have abandoned their comfort zones and attacked the president from the left for crossing the Rubicon on rights, as they rightly should.

Now is the time for more to join that call; for Americans of all stripes to speak out against so-called "laws" that enable blatant political targeting of dissidents and declare a war against the citizens of this country. Make no mistake, if we sit idly by and let this precedent become accepted-- like the Patriot Act, with the appearance of law-- more and more unconstitutional legislation will obviously take hold.

SEC. 1021. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.
(a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40; 50 U.S.C. 1541 note) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.
(b) Covered Persons- A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
(c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:
(1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.
(2) Trial under chapter 47A of title 10, United States Code (as amended by the Military Commissions Act of 2009 (title XVIII of Public Law 111-84)).
(3) Transfer for trial by an alternative court or competent tribunal having lawful jurisdiction.
(4) Transfer to the custody or control of the person's country of origin, any other foreign country, or any other foreign entity.
(d) Construction- Nothing in this section is intended to limit or expand the authority of the President or the scope of the Authorization for Use of Military Force.
(e) Authorities- Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.
(f) Requirement for Briefings of Congress- The Secretary of Defense shall regularly brief Congress regarding the application of the authority described in this section, including the organizations, entities, and individuals considered to be 'covered persons' for purposes of subsection (b)(2).
SEC. 1022. MILITARY CUSTODY FOR FOREIGN AL-QAEDA TERRORISTS.
(a) Custody Pending Disposition Under Law of War-
(1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war.
(2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1021 who is determined--
(A) to be a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda; and
(B) to have participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.
(3) DISPOSITION UNDER LAW OF WAR- For purposes of this subsection, the disposition of a person under the law of war has the meaning given in section 1021(c), except that no transfer otherwise described in paragraph (4) of that section shall be made unless consistent with the requirements of section 1028.

(4) WAIVER FOR NATIONAL SECURITY- The President may waive the requirement of paragraph (1) if the President submits to Congress a certification in writing that such a waiver is in the national security interests of the United States.

Debt repayment is a subject few want to discuss, or that few understand. We know most of the largest banks in the world are broke along with at least 6-euro zone nations.

A bill has been entered into Congress to prohibit US funds being used via the IMF to bail out European banks and governments. We see a scant chance of passage because of the elitist control of both Houses.

On the other hand it makes little difference, because the Fed has opened the swap floodgates and other avenues of secret funding to "recapitalize," bailout, European banks of all sizes and depths of default.

As we end 2011 it is all quiet on the Western Front. Behind the scenes unbeknownst to almost all - the elitists are plotting and planning on how to extricate themselves from the morass they have gotten themselves into.

How do they put the crisis on the back burner and extend the timeline? The vaunted 6 nations on the edge of default await aid, but one might ask from whom? Documents obtained by Salt Lake City attorney Jesse Trentadue in a Freedom of Information Act lawsuit show then Clinton Deputy Attorney General Eric Holder authorized members of the FBI to provide explosives to Oklahoma City bombing criminals Timothy McVeigh and Terry Nichols immediately prior to the April, 1995 bombing of the Alfred P. Murrah building.

Holder had authorized the FBI to provide the explosives to McVeigh and Nichols in conjunction with a Clinton Administration undercover operation named PATCON, an acronym for “Patriot Conspiracy.” As Jesse Trentadue describes it, “PATCON was designed to infiltrate and incite… militia[s] and evangelical Christians to violence so that the Department of Justice could crush them.” (1)

Both Waco and Ruby Ridge are now known to have been PATCON inspired, Department of Justice plots.

Shortly after the Oklahoma City bombing, Holder instructed FBI agents to recover from Terry Nichols any remainder of the explosives the Bureau had provided him and McVeigh. To the chagrin of Eric Holder, the explosives were later discovered by another agency, complete with the fingerprints of Nichols, McVeigh and 2 FBI agents. Holder had reportedly offered Nichols respite from the death penalty for his cooperation in recovering the explosives. Obviously the Deputy Attorney General considered covering up his criminal complicity in the bombing eminently worth sparing Nichols just punishment for the murders of 168 innocent Americans.

Jesse Trentadue accidentally came across PATCON while investigating the murder of his brother Kenneth at the hands of the Clinton Department of Justice. An FBI informant familiar with the Oklahoma City bombing story, Kenneth was found hanged in his cell after having been jailed by the FBI. Though an official FBI report had listed Kenneth as a suicide, it was obvious that he had been severely beaten and his throat cut.

Upon Jesse taking the federal government to court, a federal judge ruled that the FBI had not only lied about Kenneth Trentadue’s death, the Bureau was also found guilty of having destroyed evidence concerning the case. In 2001 the Trentadue family was awarded $1.1 million, $250,000 of which remains a reward for information leading to the conviction of Kenneth Trentadue’s killers.

In late November, Newsweek magazine was to run a story revealing the history of PATCON, the Oklahoma City bombing complete with the part played by Eric Holder, the FBI initiated killings at Waco and Ruby Ridge and the subsequent murder of Kenneth Trentadue. But as Mike Vanderboegh, owner of the Sipsey Street Irregulars blog reports, Newsweek senior editor Tina Brown was “convinced” by members of the Clinton and Obama Administrations to remove certain information from the lengthy R M Schneiderman article. So although originally approved for publication by Newsweek editor John Solomon, the article which finally appeared in the magazine had been cut to pieces, undoubtedly providing great relief to Holder, Clinton, Clinton Attorney General Janet Reno and many other current and former members of the Department of Justice.

It hardly needs pointed out that this and other extraordinary stories of corruption and facilitation of murder by the Clinton and Obama Administrations stink to high heaven. Rest assured that we at Coach is Right will continue to pursue the stories of PATCON, Fast and Furious and any other examples of executive branch corruption. It’s doubtful we will want for material.

California regulators frame Organic Pastures and force raw milk shut down over fabricated E. Coli scare

It has been nearly a month since the California Department of Food and Agriculture (CDFA) swooped in like vultures on Organic Pastures Dairy in Fresno, Calif., and demanded that the farm recall and stop selling all of its raw milk products immediately and indefinitely. Five children in four nearby counties had developed E. Coli, and officials automatically blamed it on the farm’s raw milk without so much as a shred of evidence proving this to be true. Nearly a month later, the state’s own tests have now determined that Organic Pastures raw milk wasnotthe culprit.

USA Today reported back on November 20, 2011, that the five children were all infected with the O157:H7 strain of E. Coli, which is believed to be contracted through food that has been contaminated with tainted fecal matter. Since all of the children’s families had allegedly purchased Organic Pastures raw milk at some point, authorities automatically blamed those products for the outbreak, and immediately ordered a full recall and quarantine of every product the company produces.

This unsubstantiated, knee-jerk reaction on behalf of the State of California is hardly surprising, as both it and the US Food and Drug Administration (FDA) have been on a crusade to destroy raw milk for decades. But what might be surprising to some is how easily these government agencies were able to target Organic Pastures without first providing a single, credible piece of evidence linking the dairy’s milk to the outbreak.

Organic Pastures employs a rigorous food safety protocol called “RAMP” (Risk Analysis & Management Program) that “voluntarily goes far beyond what is required by the CA DHS (California Department of Health Services), USDA (US Department of Agriculture), FDA or CDFA to assure that [their] raw milk is delicious and very safe.” If you review the document outlining the dairy’s step-by-step safety process for yourself, you will see that it is near-impossible for Organic Pastures dairy products to become tainted with E. But none of this matters to state regulators, which arbitrarily and immediately shut down Organic Pastures dairy before even testing the milk and verifying whether or not it was tainted. So for nearly a month now, Organic Pastures has had to sit and wait for these tests, which should have been conducted before any type of recall or quarantine, to be conducted — and all results, of course, have turned up negative for E. Government assault against Organic Pastures an act of domestic terrorism

The government’s reactionary approach to “food safety” issues involving raw milk are neither scientific nor rational. One would think that, in order to declare a food product unsafe, it might be a good idea to test it first. But when raw milk is involved, regulators always assume the worst, which typically results in a bout of hysterical and overbearing tyranny against the parties involved.

What the CDFA has done to Organic Pastures is nothing short of domestic terrorism. There was never any evidence that Organic Pastures milk products were in any way unsafe or tainted, and yet authorities appear to be doing everything in their power to keep the company from resuming production, which could eventually put it out of business.

“This is yet another example of the government engaging in outrageous acts of economic terrorism against farmers and food producers,” commented Mike Adams, the Health Ranger, on the matter.

The revelation that Halliburton subsidiary KBR is seeking sub-contractors to staff and outfit "emergency environment" camps located in five regions of the United States follows preparations over the last three years to deal with riots inside the United States that have already spread throughout Europe, North Africa and the Middle East.

As Infowars reported last night, a document sent to us by a state government employee confirms that Kellogg Brown & Root Services are looking to activate camps built for FEMA and the U.S. Army Corps of Engineers across the United States.

This follows the Senate's passage of Section 1031 of the National Defense Authorization Act which allows American citizens to be snatched off the street and held in detention camps without trial.

In 2006, KBR was contracted by Homeland Security to build detention centers designed to deal with "an emergency influx of immigrants into the U.S," or the rapid development of unspecified "new programs" that would require large numbers of people to be interned.

Since 2006, the world has been beset by riots and civil unrest as a result of the fallout from the economic collapse. From the United Kingdom, to continental Europe, to the Middle East and North Africa, almost every corner of the globe has experienced social dislocation.

Now U.S. authorities are preparing for such eventualities on home soil, with major police departments like the NYPD staging "mobilization exercises" to train police to prepare for civil disorder in the United States.

Warnings and preparation for civil unrest coming to the United States have been voiced on a regular basis.

Back in 2008, U.S. troops returning from Iraq were earmarked for "homeland patrols" with one of their roles including helping with "civil unrest and crowd control".

In December 2008, the Washington Post reported on plans to station 20,000 more U.S. troops inside America for purposes of "domestic security" from September 2011 onwards, an expansion of Northcom's militarization of the country in preparation for potential civil unrest following a total economic collapse or a mass terror attack.

A report produced that same year by the U.S. Army War College's Strategic Institute warned that the United States may experience massive civil unrest in the wake of a series of crises which it termed "strategic shock."

"Widespread civil violence inside the United States would force the defense establishment to reorient priorities in extremis to defend basic domestic order and human security," stated the report, authored by [Ret.] Lt. Col. Nathan Freir, adding that the military may be needed to quell "purposeful domestic resistance".

The United States has continuity of government plans in place should martial law be declared by the President. However, the details of those plans have been so tightly guarded that even Congressman and Homeland Security Committee member Peter DeFazio (D-OR), who has the necessary security clearance, was denied access to view the material when he requested to do so back in July 2007.

Under the terms of the the National Emergency Centers Act or HR 645, first introduced in January 2009 and still awaiting passage, emergency camps are to be made available to "meet other appropriate needs, as determined by the Secretary of Homeland Security," an open ended mandate which many fear could mean the forced detention of American citizens in the event of widespread rioting after a national emergency or total economic collapse.

With many Americans now becoming "pre-revolutionary" as a result of their fury at the Obama administration and equally unpopular lawmakers in Washington, potential civil unrest could spring not just from a poverty-stricken underclass, but also the shrinking middle class.

Indeed, top elitist Zbigniew Brzezinski warned earlier this year that middle class unrest caused by economic disenfranchisement would soon hit America.

Perhaps that's why the Department of Homeland Security is increasingly focusing its anti-terror apparatus on white middle class Americans, portraying them as domestic terrorists in a series of PSA videos. In addition, 'Occupy' protesters are also now being characterized as terrorists.

The fact that detention camps have been constructed inside America and are now being staffed and readied for "emergency" situations can no longer be ignored or ridiculed as a conspiracy theory.

Kellogg Brown & Root need to be completely transparent and explain where the camps are located, what they contain, and during what type of "emergencies" are they planned to be used for.

Infowars.com has received a document originating from Halliburton subsidiary KBR that provides details on a push to outfit FEMA and U.S. Army camps around the United States. Entitled "Project Overview and Anticipated Project Requirements," the document describes services KBR is looking to farm out to subcontractors. The document was passed on to us by a state government employee who wishes to remain anonymous for obvious reasons.

Services up for bid include catering, temporary fencing and barricades, laundry and medical services, power generation, refuse collection, and other services required for temporary "emergency environment" camps located in five regions of the United States.

Internment Camp Services Bid Arrives After NDAA

KBR's call for FEMA camp service bids arrives soon after the Senate overwhelmingly passed the National Defense Authorization Act (NDAA) which permits the military to detain and interrogate supposed domestic terror suspects in violation of the Fourth Amendment and Posse Comitatus.

Section 1031 of the NDAA bill declares the whole of the United States as a "battlefield" and allows American citizens to be arrested on U.S. soil and incarcerated in Guantanamo Bay.

A number of civil liberties groups have come out in strong opposition to the legislation, most notably the Japanese American Citizens League (JACL), the nation's oldest and largest Asian American civil and human rights organization.

In a letter addressed to Congress, S. Floyd Mori, the national director of JACL, said the NDAA is the first time that Congress has scaled back on the protections provided by the Non-Detention Act of 1971. Mori said the legislation, if enacted and put into use, would be reminiscent of the unconstitutional indefinite detention of Japanese Americans during World War II.

KBR Instrumental in Establishing Camps in 2006

In 2006, KBR was awarded a contingency contract from the Department of Homeland Security, allegedly to support its Immigration and Customs Enforcement facilities in the event of an emergency, Market Watch reported.

The contract was effective immediately and provided for establishing temporary detention and processing capabilities to expand existing ICE Detention and Removal Operations Program facilities in the event of an emergency influx of immigrants into the U.S., or to support the rapid development of new programs, KBR said. The contract may also provide migrant detention support to other government organizations in the event of an immigration emergency, as well as the development of a plan to react to a national emergency, such as a natural disaster, the company explained.

Army Releases Civilian Inmate Labor Program Document

Soon after KBR's announcement, a little-known Army document surfaced. Entitled the "Civilian Inmate Labor Program," the unclassified document describes in detail Army Regulation 210-35. The regulation, first drafted in 1997, underwent a "rapid act revision" in January 2005 and now provides a policy for the creation of labor programs and prison camps on Army installations.

National Emergency Centers Act

In 2009, the National Emergency Centers Act or HR 645 was introduced in Congress. It mandates the establishment of "national emergency centers" to be located on military installations for the purpose of providing "temporary housing, medical, and humanitarian assistance to individuals and families dislocated due to an emergency or major disaster," according to the bill.

In addition to emergencies, the legislation is designed to "meet other appropriate needs, as determined by the Secretary of Homeland Security," an open ended mandate which many fear could mean the forced detention of American citizens in the event of widespread rioting after a national emergency or total economic collapse, as Paul Joseph Watson noted in January of 2009.

Also in 2009, the Army National Guard began posting advertisements calling for Internment/Resettlement Specialists, a fact noted by Infowars.com, Prison Planet.com and other alternative media outlets but ignored by the establishment media.

Rex 84, short for Readiness Exercise 1984, was established under the pretext of a "mass exodus" of illegal aliens crossing the Mexican/US border, the same pretense used in the language of the KBR request for services.

The Senate last night codified into law the power of the U.S. military to indefinitely detain an American citizen with no charge, no trial and no oversight whatsoever with the passage of S. 1867, the National Defense Authorization Act.

One amendment that would have specifically blocked the measures from being used against U.S. citizens was voted down and the final bill was passed 93-7.

Another amendment introduced by Senate Intelligence Committee Chairman Dianne Feinstein that attempted to bar the provision from being used on American soil, an effort to ensure "the military won't be roaming our streets looking for suspected terrorists," also failed, although Feinstein voted in favor of the bill anyway.

Feinstein was able to include a largely symbolic amendment which states that "nothing in the bill changes current law relating to the detention of U.S. citizens and legal aliens," but this measure is meaningless according to Republican Congressman Justin Amash, a fierce critic of the bill.

"Some have asserted that Sen. Feinstein's amendment, S Amdt 1456, protects the rights of American citizens and preserves constitutional due process. Unfortunately, it does not. It's just more cleverly worded nonsense," Amash wrote on his Facebook page.

Though the White House has threatened to veto the bill, the fact that Obama administration lawyers yesterday reaffirmed their backing for state sponsored assassination of U.S. citizens would suggest otherwise. Not voting for the bill, or in other words upholding the oath to protect the Constitution, has been described over and over again as "political suicide".

"The bill puts military detention authority on steroids and makes it permanent, American citizens and others are at greater risk of being locked away by the military without charge or trial," said Christopher Anders, senior legislative counsel for the American Civil Liberties Union.

As Spencer Ackerman highlights, the bill completely violates the sixth amendment in that it allows American citizens to be locked up indefinitely, including in a foreign detention center, without any burden of proof whatsoever. An American merely has to be declared a terrorist and they can be abducted off the streets and never seen again.

"The detention mandate to use indefinite military detention in terrorism cases isn't limited to foreigners. It's confusing, because two different sections of the bill seem to contradict each other, but in the judgment of the University of Texas' Robert Chesney — a nonpartisan authority on military detention — "U.S. citizens are included in the grant of detention authority," writes Ackerman.

The Senate has overwhelmingly voted down an amendment to the National Defense Authorization Act that would have provided oversight to check the military’s power to arrest U.S. citizens as suspected terrorists on American soil and detain them indefinitely without trial.

“The Senate soundly defeated a move to strip out controversial language requiring mandatory detention of some terror suspects, voting it down 61 to 37 and escalating a fight with the Obama administration over the future course of the war on terror,” reports the National Journal.

The amendment, introduced by Colorado Senator Mark Udall, was an attempt to weaken Section 1031 of the NDAA bill, which would basically turn the entire “homeland” into a battlefield and allow the military to arrest individuals accused of being terrorists and detain them indefinitely without trial. Americans would be stripped of all constitutional rights and posse comitatus would cease to exist.

Confusion surrounding whether or not the bill would apply to American citizens was firmly put to bed by Republican Congressman Justin Amash yesterday, when he pointed out that the language clearly gives the executive branch the power of discretion to decide who is a terrorist, whether they are a U.S. citizen or not.

Amash described the ‘indefinite detention’ provision of the bill as “one of the most anti-liberty pieces of legislation of our lifetime.”

Senator Rand Paul has introduced a separate amendment that strikes Section 1031 from the bill altogether, but seeing as the Senate firmly rejected Udall’s watered down version, it’s unlikely Paul’s will be met sympathetically.

Although President Obama has threatened to veto the bill, political observers aren’t convinced that he will do so.

“He has said he will. Whether he will is a difficult question because, politically, it’s difficult to veto a defense spending bill that 680 pages long and includes authorization to spend on a whole range of military programs,” Daphne Eviatar, Senior Associate, Human Rights First’s Law and Security Program, told Democracy Now.

Eviatar’s organization has which has obtained signatures from 26 retired military leaders urging the Senate to vote down the legislation if the ‘indefinite detention’ provision is not removed.

“This would be the first time since the McCarthy era that the United States Congress has tried to do this,” warned Eviatar. “In the 1950’s, that was actually repealed before it was ever used. In this case have seen the administration very eagerly hold people without trial for 10 plus years in military detention, so there’s no reason to believe they wouldn’t continue to do that here. So we’re talking about indefinite military detention of U.S. citizens, of lawful U.S. residents as well as of people abroad.”

"I had spent a good part of my life enforcing the penal code, but not understanding my oath of office," Sheriff Dean Wilson of Del Norte (Sacramento) County told the group.

"I was ignorant and naive, but now I know of the assault against our people by the federal government," he said, receiving some of the loudest and longest applause of the gathering.

Event host Sheriff John Lopey of Siskiyou (California) County said one of his biggest pet peeves was the federal government's ever-increasing environmental regulations.

Gerald Celente: CME (Chicago Mercantile Exchange) Did Not Honor Their Oversight Guarantee in MF Global Scandal

Bloomberg reports today that CME, the world's largest futures exchange, may face liability in the MF Global scam that has bilked customers out of nearly a billion dollars.

Back on October 30, it was reported that CME noticed a shortfall in MF Global's segregated client funds, but did not immediately report it to the Commodity Futures Trading Commission, the CME Group's regulator.

CME oversees its futures-broker members such as MF Global under its authority as a self-regulatory organization and is required to report irregularities immediately.

CME's behavior is especially suspect after $600 million fell in a back hole when it was placed in an account with Wall Street giant JP Morgan following the collapse of MF Global.

As we noted today, it is very suspicious that weeks prior to MF Global's fall billionaire investors like the Koch brothers had the miraculous foresight to withdraw all their money, prompting accusations that big players got a 'heads up' in advance of the firm's collapse.

CME is now in the process of damage control. Earlier today, the organization issued a press release stating that it “followed CFTC requirements and CME Rules and procedures in reviewing MF Global's segregated funds statements and coordinating that review with the CFTC" and characterized reports that it was negligent as "inaccuracies."

Trends forecaster Gerald Celente, who lost gold futures at MF Global in the six figure range, has discovered a video of CME Executive Chairman, Terrence Duffy, holding a press conference last year in which he unequivocally states that “no customer has ever lost a penny as a result of a clearing member default at CME Group."

It is with regret and unflinching moral certainty that I announce that Barnhardt Capital Management has ceased operations. After six years of operating as an independent introducing brokerage, and eight years of employment as a broker before that, I found myself, this morning, for the first time since I was 20 years old, watching the futures and options markets open not as a participant, but as a mere spectator.

The reason for my decision to pull the plug was excruciatingly simple: I could no longer tell my clients that their monies and positions were safe in the futures and options markets – because they are not. And this goes not just for my clients, but for every futures and options account in the United States. The entire system has been utterly destroyed by the MF Global collapse. Given this sad reality, I could not in good conscience take one more step as a commodity broker, soliciting trades that I knew were unsafe or holding funds that I knew to be in jeopardy.

Radley Balko, a civil libertarian best known for his work at Reason, Cato, and the Huffington Post, talks with John Stossel about the need for citizens to be able to film the police.

In one clip, they show how an officer intentionally throws himself into a bicyclist while proclaiming the cyclist intentionally rammed him.

In another clip, a policeman denies drawing his gun at a snowball fight when the video clearly shows that he did.

Should the police feel afraid to act if they are filmed? If they are doing their job correctly, why should they? At the end of the show, Stossel dicusses the corruption of Nixon's vice president Spiro Agnew and the corruption he and many other politicians were found guilty of. Isn't it good that we have a record of their corruption so that justice could be served? Shouldn't the same standard be applied to the police?

Stossel's final point: individuals deserve privacy, individuals who get public money (such as ACORN administrators) deserve less privacy, and people who receive government money AND who have the ability to forcibly control you - and the authority to hold a gun to your head - deserve to be held fully accountable and absolutely should be video recorded.

Florida Cop Arrests Miami Police Officer For Speeding 120 MPH

HOLLYWOOD, Fla. -- A city of Miami police officer was caught driving 120 mph and a Florida Highway Patrol trooper followed him for several minutes before issuing him a ticket, said FHP.

Fausto Lopez, 35, was charged with reckless driving.
According to the police report, Lopez was driving at a high rate of speed in a marked police car southbound on the Florida Turnpike near mile marker 62 at 6:28 a.m. on Oct. 11 when a FHP trooper saw him crossing over several lanes.

That FHP trooper followed him and tried pulling him over, but he first ignored her sirens, according to the report.

Dash cam video showed Lopez's car as the sirens and emergency lights of the trooper's car were activated.

The police report said Lopez slowed down to 78 mph before speeding up again.
Seven minutes and 12 miles after first seeing Lopez drive past, he pulled over. In the video, the trooper was seen drawing her gun before handcuffing Lopez.

"I never saw you," Lopez told the FHP trooper.

"How do you not see a car with blue lights in the dark," she asked him.

Lopez told the trooper that he was on his way to an off-duty job at a school in Coconut Grove.

"I had to get there by 7 a.m. and didn't think I was going to make it," he said.

Lopez also asked that the FHP trooper remove the handcuffs.

"Honestly, the handcuffs are not necessary, ma'am. I'm very cooperative," he told her.

"You know what you are to me? You are a criminal," she told him.
Lopez was eventually released and cited for a moving violation.

The company behind a Department of Homeland Security-funded project to install street lights that double as sophisticated surveillance devices pulled its promo video for 'Intellistreets' from You Tube hours after our article drawing attention to the issue was linked on the popular Drudge Report website.

Having initially disabled comments on the You Tube clip, Illuminating Concepts yanked the video entirely this afternoon, presumably nervous about the negative publicity that could be generated from concerns about new high-tech street lights being used for "Homeland Security" purposes -- their words, not ours.

However, having gone to the trouble of putting together a promotional video for their product, and having already started installing the system in the city of Farmington Hills, Michigan with the aid of federal funding, the fact that the company attempted to prevent people learning about the "Homeland Security" applications for the street lights speaks volumes.

If 'Intellistreets' is such a cutting edge concept that presents an array of wonderful benefits, as the promo video claims, then why remove it from You Tube? It's almost like a kid getting caught with his hand in the cookie jar.

Appearing on the Alex Jones Show today, investigative journalist Wayne Madsen said his sources in Libya provided information revealing Moammar Gaddafi was set-up in an assassination plot.

Early on October 19, Twitter messages from Gaddafi's hometown of Sirte reported the presence of white flags across the devastated town. Flags were reported at multiple locations in the town, leaving some to believe the rebels were surrendering,

The use of white flags to signal surrender is an ancient tradition going back to the Eastern Han dynasty in China and the Roman Empire. Violating the widely accept convention is considered an act of extreme treachery.

Under both the Geneva and Hague protocols of international humanitarian law, it is forbidden to kill or injure persons hors de combat (outside of combat) and doing so constitutes a major war crime.

Madsen's sources said Gaddafi was told to surrender to the al-Qaeda rebels besieging Sirte before morning prayers at 5 am, but that it was decided to surrender after the sun was well up in the sky so the white flags would be clearly visible.

It also appears likely the arrival of Secretary of State Clinton in Libya may have played into the plot and convinced Gaddafi to surrender.

According to official accounts, however, Gaddafi was attempting to flee Sirte and avoid surrender.

He was wounded in a Predator drone attack and subsequently killed by crossfire, either from the rebels or Gaddafi supporters. Video footage released hours after the attack, however, clearly reveals a seriously wounded Gaddafi abused by a crowd of rebels. A choppy cell phone video then shows the body of the deposed leader.

A NATO rebel fighter later bragged that he had killed Gaddafi.

Both Madsen and Jones said the official cover story does not make sense. If Gaddafi wanted to escape Sirte, why didn't he do it under the over of darkness? It makes little sense to attempt an escape convoy in broad daylight in rebel territory with U.S. predator drones likely on constant patrol.

Madsen's information reveals that Gaddafi was set-up for a double-cross and execution. Dead men, as they say, tell no tales. Gaddafi's cooperation with the globalists, his business deals with the war criminal Tony Blair at the behest of JP Morgan, his talk of nationalizing Libya's oil fields, his close relationship with oil corporations and American politicans like John McCain were all liabilities for the elite and would have been extremely problematic if he had surrendered and faced the ICC at the Hague.

“CNN's John King discovers an interview with President Barack Obama that directly refutes Attorney General Eric Holder's testimony before congress,” the caption for a video posted on BreitbartTV claims.

The reason for this claim is because Obama spoke about “Fast and Furious” in March. Holder declared in May that he had only heard about the gunwalking program “for the first time over the last few weeks.”

“I'm ashamed I didn't pick up on this before,” Mike Vanderboegh of Sipsey Street Irregulars admits. “Sheesh, it was hiding in plain sight.”

Vanderboegh is not the only one who missed the obvious. Even more embarrassing, Gun Rights Examiner reported “Holder revelations contradict Obama’s ‘Gunwalker’ assertions” on October 4, referencing the same video King “discovered,” but failed to notice and note the date of the president’s interview.

The King report concludes with Rep. Elijah Cummings, who continues with his partisan covering for Holder while, in other venues, he attacks the efforts of Darrell Issa as “a gross abuse of Committee authority.” Considering his personal culpability in ignoring allegations of corruption and abuse by ATF agents at a time when “Gunwalker” could have been nipped in the bud, that is hardly surprising.

President Barack Obama's public support for the Occupy Wall Street movement, whether welcomed or not by the protesters, represents a clear effort on behalf of the White House to use class warfare as an election campaign tool, but it could lead to a complete financial collapse in the United States.

During a speech to honor Dr. Martin Luther King on Sunday, Obama "offered more support for protesters" according to the Financial Times when he spoke of them favorably for challenging "the excesses of Wall Street".

In addition, a White House staffer, Principal Deputy Press Secretary Josh Earnest, told a press conference yesterday that Obama will make sure "the interests of the 99 percent of Americans are well-represented on the tour," which is the first time the White House has invoked a mantra that has become synonymous with the OWS movement.

The Obama administration's adoption of the "99 percent" slogan is a clear sign that the Occupy Wall Street movement is being exploited as an Obama campaign tool. As ourselves and others predicted weeks ago, Obama will use the demonstrations as a populist gimmick to imply that his political opposition sides with the 1 percent who have contributed to America's economic decline.

Of course, the disgusting irony behind Obama's "support" for Occupy Wall Street demonstrators is the fact that his 2008 campaign was financed by Goldman Sachs, JP Morgan, Citigroup and Morgan Stanley, and Obama is even more reliant on Wall Street for his 2012 campaign. Moreover, Obama's cabinet is stuffed with former Wall Street insiders.

The OWS demonstrators themselves are seemingly split down the middle. Most of them voted for Obama and a significant number are set to do so again next year, despite the fact that his administration has aggressively supported bailouts to banks, the majority of which are not even based in the United States, to the tune of trillions of dollars.

We are now seeing the 'Occupy' movement advocate Americans withdraw all their money simultaneously, in an effort to cause a run on the banks. The first such campaign is labeled "Bank Transfer Day," and will take place on November 5. Banks are already preventing people from closing their accounts, and there were arrests made at a branch of Citibank in New York this past weekend.

Should the White House's support for the demonstrators embolden them to initiate a successful nationwide campaign for a run on the banks, the subsequent collapse of the banking system would make Lehman Brothers look like a walk in the park. Obama could then blame the demonstrators for the collapse and thereby disguise the fact that it was precipitated by the Federal Reserve's policy of quantitative easing, which has been fully supported by his administration at every turn.

Rand Paul's warning that Obama's rhetoric could provoke the OWS demonstrators into behaving like an unruly mob would represent the perfect pretext for Obama to use the protesters as a scapegoat for America's financial and social decline.

With Obama lobbying group MoveOn.org now moving to completely infiltrate and direct the Occupy Wall Street movement, the Obama campaign will increasingly attempt to align itself with the protesters in a bid to isolate Obama's political opposition.

The Obama campaign will attempt to mobilize an army of angry Americans into an unwieldy mob by convincing them that Obama is genuinely opposing Wall Street corruption, when in reality his administration's disastrous policies are the primary reason for America's economic stagnation.

This cynical ploy not only represents a transparent bid to exploit the frustration of millions of Americans and turn it into a cheap campaign stunt, but it could also threaten to cause a complete collapse of the financial system, a loss of confidence in the dollar, and a run on the banks if Obama's support for the 'Occupy' movement precipitates a massive wave of social dislocation.

The Texas border region represents 9.7 percent of the state's population, yet the region has 19.2 percent of the state's juvenile felony drug referrals and 21.8% of the state's juvenile felony gang referrals.

According to DPS, six of the seven Mexican cartels have established command and control networks in Texas, and they are recruiting Texas students to support their drug, human, currency and weapon smuggling operations on both sides of the Texas-Mexico border.

The state agency warns cartels and their operatives are extremely violent, torturing and killing thousands of people in Mexico. They use transnational and Texas prison gangs to further their criminal operations in Mexico and the U.S.

DPS officials urge parents, especially those who live along the border, to talk to their children and explain how the cartels seek to exploit Texas teenagers and the risks involved in dealing with these ruthless organizations.

Evidence suggests that ACORN, the Left’s premiere astro-turfing organization, has been paying people to participate in the Occupy Wall Street protests.

Astro-turfing campaigns can generate big money, and ACORN’s lucrative protest-for-profit program is nothing new. As Matthew Vadum notes in his book, Subversion Inc.: How Obama’s ACORN Red Shirts are Still Terrorizing and Ripping Off American Taxpayers, ACORN has acquired great expertise in manufacturing so-called grassroots protests.

Left-wing loan sharks Herb and Marion Sandler, the founders of World Savings Bank, gave ACORN affiliates close to $11 million to manufacture mobs to protest their competition in subprime mortgage lending. The United Federation of Teachers paid ACORN $500,000 to create a “spontaneous uprising” against charter schools in Manhattan.

The sleazy, SEIU-funded Working Families Party, a front group for ACORN, placed a want ad on the Craig’s List website dated Sept. 26. The ad indicates that WFP was recruiting activists to carry out “direct action,” leftist argot for a variety of activities aimed at forcing sociopolitical change. The line between direct action and violent terrorism can become blurry. Extreme forms of direct action can lead to bodily injury and sometimes death. The labor movement is no stranger to assault and killings. Left-wing activists David Gilbert and Kathy Boudin participated in an attack on an armored car that left two police officers and a security guard dead. Two anarchists tried to disrupt the 2008 GOP convention with Molotov cocktails. The eco-terrorist Sea Shepherd Conservation Society admits both to attacking whaling ships with acid and sinking them.

WFP’s ad is titled, “FIGHT TO HOLD WALLSTREET ACCOUNTABLE NOW! MAKE A DIFFERENCE GET PAID!” It states:

Only outgoing, articulate dedicated, determined candidates will be considered for the positions.

This is not a policy job! Through direct action you will be shaping NY state politics for the next 20 years.” [emphasis added]

As previously reported, WFP has been involved in organizing the Occupy Wall Street protests since the beginning.

As radical journalist Laura Flanders reported, WFP organizer Nelini Stamp has “been here since day one and she is part of the organizing team and the outreach team that has managed to bridge the distance between that first day and this day and between the grassroots folks here and the labor movement.” Stamp said the protests are aimed at “trying to change the capitalist system” and bringing “revolutionary changes to the states.”

WFP organizer Matthew Cain also acknowledged the party’s involvement Oct. 5 and helpfully provided a photograph of party staffers bearing a blue and white WFP banner during a march in lower Manhattan. Across from Foley Square,

several WFP field staff were standing on the steps. For some of the staffers, it was their first time at the square, but for many others they had already spent nights sleeping in the park. Even those who have been there for two weeks or more have not seen their spirits diminished – they’re every bit as committed as they were when they first showed up.

Of course WFP executive director Dan Cantor, a longtime ACORN operative, is pleased with Occupy Wall Street so far. Cantor told supporters in an email that “the spirit of Wisconsin and Tahrir Square is alive and well in New York City.”
